Reasons for Divorce: Divorces in New Jersey may be based on fault or no fault at all. Irreconcilable differences—a marriage that has irretrievably broken down for a minimum of six months and for which there is no realistic chance of reconciliation—are the basis for no-fault divorces. Adultery, deserting, severe brutality, incarceration, chronic intoxication, and abnormal sexual behaviour are examples of fault-based grounds.

Residency Requirements: One spouse must have lived in New Jersey for the last year in order to petition for divorce in the state.
